Conditions générales de vente

Last updated: April 2026. These General Terms of Sale and Use apply to the Mistglide online store, all product pages, carts, checkout flows, customer support requests and policy pages linked from the footer.

By visiting the store, adding a product to the cart, placing an order, contacting support or using any checkout feature, the customer agrees to these terms, the privacy policy, delivery information, refund policy and withdrawal information. If the customer does not agree, they should not place an order.

Definitions

“Store” means the Mistglide storefront and its pages. “Product” means Mistglide Brush and any related offer, bundle, accessory, gift item or product variation shown on the store. “Customer” means any person placing or attempting to place an order. “Consumer” means a natural person acting for purposes outside their trade, business or profession. “Support” means the customer assistance route available through the contact page linked in the footer.

Online store conditions

The customer must use the store lawfully, provide accurate information and avoid fraudulent, abusive, automated, harmful or unauthorized use. The customer must not transmit malicious code, interfere with checkout, scrape protected content at scale, impersonate another person, abuse promotions or attempt unauthorized access to the store infrastructure.

The store may refuse service, cancel an order, suspend access or preserve records when fraud, payment abuse, security risk, policy abuse or unlawful activity is reasonably suspected, within the limits allowed by applicable law.

Customer account and checkout information

A customer account is not required unless Shopify or an enabled feature makes it available for order history, customer identity or support. If an account is used, the customer is responsible for keeping credentials confidential and for notifying support if unauthorized use is suspected.

The customer is responsible for complete and accurate checkout information, including name, email, delivery address, billing details, phone number if requested by the carrier, country, postal code, apartment number and access details. Incorrect or incomplete information can delay delivery, prevent support from identifying an order or make address changes impossible after fulfilment starts.

Product information and use

Mistglide Brush is a beauty accessory intended for ordinary hair touch-ups, flyaways and quick grooming routines. Product pages may describe use cases, colors, bundle offers, expected routines, customer experiences and visual results. Results vary depending on hair type, humidity, hair condition, prior styling, routine and use.

Product content is informational. It is not medical advice, a professional salon diagnosis, a promise of permanent hair change or a guarantee that every customer will obtain the same result. The customer should follow any instructions included with the product or packaging and stop using the product if it appears damaged or unsafe.

Accuracy of information

The store aims to keep product, pricing, delivery, stock and policy information accurate and current, but errors, omissions, outdated information, display differences and technical issues may occur. The store may correct mistakes, update pages or cancel clearly erroneous orders where allowed by law.

Some visuals, examples, reviews, icons or generated assets may be used to explain the product and shopping experience. Minor differences may occur because of screen settings, lighting, production batches, packaging updates or localization.

Prices, promotions and payment

Prices are shown in the currency available for the selected Shopify Market. Taxes, duties, delivery method, discounts and final total are shown before payment confirmation. The customer should review the full checkout summary before placing the order.

Promotions, bundles, free gifts and discounts may be modified, paused or withdrawn before an order is placed. A promotion is valid only if Shopify checkout applies it successfully. Removing items, changing quantities or changing market may remove a discount.

Payments are processed through Shopify checkout and enabled payment providers. The theme does not store full card numbers. Payment authorization, fraud screening, chargebacks, refund processing and payment security may be handled by third-party payment providers under their own rules.

Order acceptance and cancellation

An order is submitted when Shopify checkout is completed and payment authorization is accepted. The store may refuse, cancel or refund an order when payment fails, fraud is suspected, the destination is unsupported, stock is unavailable, pricing is clearly incorrect, checkout information is incomplete or fulfilment cannot reasonably be completed.

If the customer wants to cancel or change an order, they should contact support as soon as possible. Once an order is being prepared, transmitted to fulfilment, handed to a carrier or shipped, cancellation, address changes or color changes may no longer be possible.

Delivery

Delivery is available only to supported destinations shown in checkout. Free tracked delivery may be available for supported markets. Delivery estimates are informational and run from order processing, not necessarily from the moment the order is placed.

Usual delivery estimates may vary because of carrier capacity, public holidays, customs or import formalities, weather, strikes, local disruptions, remote areas, incorrect addresses, uncollected parcels or other events outside the store’s direct control. Tracking is sent when available and may take time to activate after the first carrier scan.

Customer responsibility at delivery

The customer should inspect the parcel and product after delivery. If the parcel is visibly damaged, opened or incomplete, the customer should document the issue, keep the packaging and contact support promptly with order number, checkout email, photos or video and tracking information.

If a parcel is returned because the address was incomplete, delivery was refused, the parcel was not collected or the customer was unavailable, reshipping may require address confirmation and may involve additional carrier costs where allowed by law.

Thirty-day voluntary return policy

In addition to mandatory rights, the store may offer a voluntary 30-day return policy from delivery. The customer must contact support before sending any product back. Return instructions are necessary so the parcel can be identified and matched to the order.

Returned products should be unused, clean, complete, undamaged after delivery and returned with original packaging and accessories where reasonably possible. Items showing excessive handling, hygiene concerns, missing parts, customer-caused damage or insufficient order identification may be refused or partially refunded where allowed by law.

Statutory withdrawal rights

Where applicable to consumers, the statutory right of withdrawal may allow cancellation within 14 days after delivery without giving a reason, subject to legal exceptions. The customer must send a clear withdrawal statement before the deadline and return the product within the legal return period after notification.

Refunds under a valid withdrawal right are handled according to applicable consumer law. The customer may be responsible for direct return shipping costs unless the store agreed otherwise or mandatory law requires a different treatment. The customer remains responsible for any diminished value caused by handling beyond what is necessary to inspect the nature, characteristics and functioning of the product.

Exceptions and limited returns

Returns may be refused or limited where permitted by law for personalized products, sealed products that cannot be returned for hygiene reasons once unsealed, products returned incomplete or damaged, products showing excessive use, items that cannot be matched to an order, items returned outside the applicable period, or any case where acceptance would conflict with health, safety, fraud-prevention or legal requirements.

Refunds

Refunds are issued to the original payment method when possible. The store can submit an approved refund, but the final appearance on a statement depends on the payment provider, card issuer, bank or wallet provider. Processing times may vary.

Refunds may be full or partial depending on the reason for return, product condition, missing items, promotional gifts, bundle structure, delivery charges, return shipping responsibility and mandatory consumer law. If the order included a free gift, bundle discount or promotional item, refund calculation may be adjusted if not all connected items are returned.

Legal guarantees

Nothing in these terms limits mandatory legal guarantees or non-excludable consumer rights. Where a product is defective, damaged on arrival or not as described, the customer may be entitled to repair, replacement, refund or another remedy under applicable law. The customer should contact support with clear evidence so the case can be reviewed.

Chargebacks and payment disputes

If an issue arises, the customer is encouraged to contact support before opening a payment dispute, so delivery, defect, billing or refund questions can be reviewed quickly. The store may respond to chargebacks with order records, tracking, customer communications, policy pages and fulfilment evidence.

Fraudulent disputes, false non-delivery claims after confirmed delivery or abusive payment behavior may lead to order refusal, account restrictions, evidence submission to payment providers and any lawful recovery steps. Legitimate disputes remain unaffected.

Third-party tools and services

The store uses Shopify infrastructure and may rely on payment providers, delivery providers, fulfilment partners, analytics tools, review tools, email tools, fraud-prevention services and other Shopify-compatible services. These providers operate under their own technical and legal conditions. The store is not responsible for third-party websites or services not controlled by the store.

Personal data

Personal data is handled according to the privacy policy. The store may process data needed to display the store, operate checkout, prepare orders, deliver parcels, respond to support requests, prevent fraud, comply with accounting or tax obligations and manage returns or refunds.

Prohibited uses

The customer must not use the store for unlawful purposes, infringement of intellectual property, harassment, abusive conduct, malware transmission, scraping protected content, fraud, payment abuse, false information, security attacks, unauthorized data collection or interference with the store, Shopify checkout or other customers.

Intellectual property

All store content, including copy, product images, generated visuals, layout, icons, logos, design, code, product presentation, reviews selection and brand elements, is protected by intellectual property rules. It may not be copied, reproduced, republished, resold, scraped, distributed or used to create a competing store without permission, except where mandatory law allows limited use.

Limitation of liability

The store aims to keep service available and information accurate, but cannot guarantee uninterrupted, error-free or delay-free operation. To the maximum extent permitted by law, the store is not liable for indirect losses, lost profits, data loss, external provider failures, carrier delays, payment provider issues, misuse of products or use contrary to instructions. Nothing excludes liability that cannot legally be excluded.

Force majeure

The store is not responsible for delay or non-performance caused by events beyond reasonable control, including carrier disruptions, strikes, customs delays, weather events, natural disasters, pandemics, war, cyber incidents, platform outages, supplier interruption or legal restrictions. The store will aim to inform customers and propose an appropriate solution when feasible.

Dispute handling and mediation

Customers should contact support in writing before any formal dispute so the issue can be reviewed. Consumers may have access to national or local consumer mediation or alternative dispute resolution mechanisms depending on their country. The former European Commission Online Dispute Resolution platform is no longer available, so customers should use current national consumer redress resources where applicable.

Governing law and mandatory rights

These terms are interpreted with respect to the laws applicable to the transaction and the customer’s mandatory consumer protections. If a mandatory local rule gives the customer stronger rights than these terms, that mandatory rule prevails.

Severability and changes

If one clause is invalid or unenforceable, the remaining clauses remain effective to the extent allowed by law. The store may update these terms to reflect operational, legal, Shopify, payment, delivery or product changes. The version in force when the customer places the order applies to that order unless mandatory law provides otherwise.

Contact

For questions about these terms, an order, a delivery issue, a return, a refund, privacy request or product support, the customer should use the contact page linked in the footer and include the order number, checkout email, delivery country and a clear description of the request.
